Terms of Service

By creating an account or using Nudgr (“Service”), you agree to these Terms of Service (“Terms”). If you are using Nudgr on behalf of a business, you represent that you have authority to bind that business to these Terms.

Nudgr is operated by Nudgr Ltd (“we”, “us”, “our”). Our service is available at getnudgr.com.

Nudgr is a SaaS platform that connects to gym and fitness management software (including GymMaster, Mindbody, and others) to provide member retention intelligence, at-risk scoring, automated outreach sequences, and related analytics for gym and fitness business operators.

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@getnudgr.com if you suspect unauthorised access.

Nudgr offers a free tier and paid Enterprise plans. Free tier features are provided as-is and may be modified or discontinued at any time. Paid plans are billed monthly through Stripe. You may cancel at any time and your access continues until the end of the current billing period. No refunds are provided for partial months.

Your data: You retain ownership of all data you bring into Nudgr from your gym management software. We do not sell your data or your members’ data to third parties.

Member data: By connecting your gym management software to Nudgr, you confirm that your members have consented to their data being used for retention and communication purposes, consistent with your membership agreements and applicable law.

Our use: We use your data solely to provide the Nudgr service, including generating member scores, sending outreach sequences on your behalf, and producing analytics.

You agree not to:

• Use Nudgr to send unsolicited communications to members who have opted out
• Attempt to reverse engineer, copy, or resell the Nudgr platform
• Use the service for any unlawful purpose
• Interfere with or disrupt the service or its infrastructure

Nudgr’s automated winback and retention sequences send communications to your gym members on your behalf. You are responsible for ensuring your membership agreements permit such communications. You can disable automated sequences at any time from your settings.

Nudgr connects to third-party platforms (GymMaster, Mindbody, etc.) using credentials you provide. We are not responsible for the availability, accuracy, or changes to those third-party platforms. You are responsible for ensuring you have the right to connect those platforms to Nudgr.

Nudgr and its technology, design, and content are owned by Nudgr Ltd. You are granted a limited, non-exclusive licence to use the service during your subscription. You may not copy, modify, or distribute any part of the service.

To the maximum extent permitted by law, Nudgr Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

The service is provided “as is” without warranty of any kind. We do not warrant that the service will be error-free, uninterrupted, or that member retention outcomes will meet your expectations.

We may suspend or terminate your account if you breach these Terms. You may terminate your account at any time by contacting hello@getnudgr.com. Upon termination, your data will be retained for 30 days before deletion.

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.

We may update these Terms from time to time. We will notify you by email of material changes. Continued use of the service after changes constitutes acceptance.
